1. Information prior to the contracting process
This website, www.privata.com, is owned by BARBET 99 S.L. (hereinafter PRIVATA), with Tax Identification Number (CIF) B-95020475 and registered office at Calle Socamino, No. 5, 39820 Limpias – Cantabria (Spain). It is registered in the Mercantile Registry of Santander in volume 1174, folio 158, page no. S-32374.
These General Terms and Conditions govern the distance selling relationship between PRIVATA and the Customer or user.
PRIVATA reserves the right to make any modifications it deems appropriate to these General Terms and Conditions without prior notice. Such modifications may be made through its websites, by any legally permissible means, and will be binding for as long as they are published on the website and until they are validly modified by subsequent changes. However, PRIVATA reserves the right to apply, in certain cases, Specific Terms and Conditions of Sale in preference to these General Terms and Conditions when it deems it appropriate, announcing them in a timely and proper manner.
The duration of the contract will be linked to the delivery of the product, without prejudice to the right of withdrawal. As a Customer or user, you expressly declare that you know, understand, and accept the terms of use and these general terms and conditions of sale. Likewise, you declare that you are of legal age and have the legal capacity to access PRIVATA's websites and to contract through them.

It is essential that you register as a website user to make an online purchase. You can access the corresponding registration section on the website itself.
Unless you notify us otherwise, we will assume that your information has not been modified and that you agree to notify us of any changes.
During the purchase process, you must identify yourself with the username and password provided. This information will not be made public. You are responsible for treating your username and password obtained during registration as a customer confidentially and responsibly, and may not share them with anyone else. You can modify your registered information at any time in your customer area. In this same section, you will have access to your order history. This is for viewing purposes only, but you can manage your order history by deleting records you no longer wish to see.
Once the purchase process is complete, the customer will receive an order confirmation via email. It is essential that the user provides a valid email address during the purchase process. If you do not receive confirmation within 24 hours of placing your order, please contact PRIVATA at shop@privata.com.
Upon receiving the product at the provided delivery address, the customer will receive an invoice or order confirmation.
2. Territorial Scope of Application
The sale of PRIVATA products is available in mainland Spain, the Balearic Islands, and Andorra.
3. Offer and Validity
In the case of a product on sale, the sale price will always be indicated along with its essential characteristics.
PRIVATA provides information on all items for sale, their characteristics, and prices. However, PRIVATA reserves the right to withdraw, restock, or change the products offered through its website by simply updating the website's content. Therefore, the products offered at any given time on the website will be governed by the General Terms and Conditions of Sale in effect at that time. Likewise, the company may discontinue offering access to the aforementioned products at any time without prior notice.
4. Essential Characteristics of the Products
The products offered in our online store include a description, several photographs, and their essential characteristics. The product color shown in the photograph is not binding. The color is specified in the product characteristics. It does so in the most realistic way possible, with the utmost diligence and precision. However, for added security and guarantees, the images or information provided about the products in their descriptions are not binding on either PRIVATA or the Customer until the order has been accepted.
5 Guarantees
This textile product is subject to the guarantee of conformity. This guarantee provides a period of two years for manufacturing or production defects, starting from the date of purchase. There is a six-month statutory period for verifying manufacturing defects, during which the supplier must demonstrate whether or not the product is correct. After six months, this responsibility passes to the buyer.
6. Prices
All products are listed in Euros and include Value Added Tax (VAT).
If any other taxes are applicable, they will be indicated.
7. Delivery and Shipping Costs
No shipping costs will be charged; the price shown is the total price.
All purchases will be delivered by MRW courier service from Monday to Friday, excluding local and national holidays, within a maximum of five (5) business days from confirmation of the order, subject to availability. PRIVATA will not be liable for delays that are unforeseeable and/or solely attributable to the courier company.
For security reasons, products purchased through the Website will be delivered exclusively to the address expressly identified by the Customer during the purchase process. The signature of the Customer or a designated adult over 18 years of age will be required upon delivery. PRIVATA does not deliver to P.O. boxes.
The Customer or their designated representative must be present at the delivery address indicated on the delivery note. Upon delivery of the goods by the courier company, the Customer is obligated to verify:
a) That the number of items delivered corresponds to the number indicated on the delivery note, and
b) That the packaging and its seals are intact and in good condition, not altered in any way. Any damage to the delivery package and/or the product, or discrepancies in the number of items or documentation, must be immediately noted in writing on the courier's delivery note. Once the courier company's document has been signed and the customer has not raised any objection, the customer may not raise any objection regarding the external characteristics of the delivered package.
8. Payment Methods and Order Processing
The customer may pay for their order using any of the following methods. During the purchase process, they must indicate their choice:
8.1 VISA, MAESTRO, or MASTERCARD Credit Card
All transactions involving the transmission of personal or banking data are carried out using a secure environment, a server based on the standard SSL (Secure Sockets Layer) security technology.
Likewise, your credit card details are entered directly on the bank's website, at the POS (Point of Sale Terminal), and are neither entered nor stored on any PRIVATA server.
When paying with a VISA or MASTERCARD, you will always be asked for the following information: the card number, the expiration date, and a Validation Code, which corresponds to the last three digits of the number printed in italics on the back of your VISA or MASTERCARD. This provides greater security for the transaction.
This payment method is valid only on the website.
If a purchase amount has been fraudulently or improperly charged using a payment card number, the cardholder may request immediate cancellation of the charge. In such cases, the corresponding debit and credit entries in the accounts of the supplier and the cardholder will be made as soon as possible.
However, if the purchase was indeed made by the cardholder and the request for a refund is not due to the exercise of the right of withdrawal or termination, and therefore the corresponding charge was improperly disputed, the cardholder will be liable to PRIVATA for any damages incurred as a result of said dispute.
8.2. PayPal
This system will open the PayPal payment platform for you. From that moment on, payment for our products will be governed by the specific terms and conditions provided by the PayPal platform.
9. Right of Withdrawal, Returns, and Claims
The Customer has a maximum of fourteen (14) calendar days to withdraw from the purchase, starting from the day the Customer receives the product, without penalty and without having to provide a reason.
The right of withdrawal must be exercised by notifying PRIVATA via telephone, by email to shop@privata.com, or through the contact form.
